Terms of Service

Scope

These Terms of Service (“Terms”) govern your use of supaskills.ai (“Platform”), operated by Kill The Dragon GmbH, Dürergasse 3 / TOP 4 / HOF, 1060 Vienna, Austria (“we”, “us”, “Operator”).

By creating an account, you agree to these Terms.

Service Description

SupaSkills is an API platform and marketplace for specialized AI system prompts (“Skills”), accessible via REST API, MCP protocol, and web interface. Each Skill is a research-backed, quality-verified system prompt that transforms Claude (by Anthropic) into a domain expert.

What SupaSkills does NOT provide:

• Not an AI model: we provide prompts (structured instructions), not the AI model itself. We do not control what the AI model generates.
• Not professional advice: Skills covering health, mental health, nutrition, finance, legal, parenting, relationship, or security topics are educational guidance only. They do not replace licensed physicians, therapists, dietitians, financial advisors, attorneys, or other qualified professionals.
• No guarantee of AI outputs: the quality of AI responses depends on your input, context, and the AI model. AI outputs may contain errors, hallucinations, fabricated citations, or outdated information.
• No guarantee of code quality: Skills that generate or review code do not guarantee that the output is correct, secure, complete, or fit for production use. You are responsible for testing, reviewing, and validating all code before deployment.

Service Availability

SupaSkills is provided “as is” and “as available”. We strive for high availability but do not guarantee uninterrupted, error-free operation. Planned and unplanned maintenance may temporarily limit access to the Platform.

We are not liable for temporary interruptions caused by maintenance, updates, technical issues, or circumstances beyond our control (force majeure), including but not limited to: internet outages, third-party service failures, natural disasters, or government actions.

Plans and Pricing

All prices are inclusive of applicable VAT.

SkillStreaming

• SkillStreaming dynamically retrieves relevant SubSkill fragments from across the skill catalog per query
• Queries are counted monthly and reset on the first of each month
• Free plan users receive up to Platinum-tier SubSkills; Diamond-tier SubSkills require Pro or Max
• Token budgets are plan-dependent: Free (2,500), Pro (5,500), Max (8,000)

Skill Slot System

• Full skill loading (load_skill) occupies one slot for 7 days
• After 7 days, the slot is automatically released
• Re-loading the same skill within 7 days does not consume a new slot
• Manual deactivation is possible at any time
• At activation, the current skill version is pinned; updates are delivered on re-activation

Cancellation and Refunds

• Monthly: Cancel at any time. Access continues until the end of the billing period.
• Annual: Cancel at any time with a maximum notice period of 2 months. Pro-rated refund for remaining full months.
• Cancel via the Stripe Customer Portal in your account settings, or by email to billing@supaskills.ai.

After cancellation, you have 30 days to export your data.

Right of Withdrawal (Widerrufsrecht)

Your Right to Cancel

If you are a consumer in the European Union or the European Economic Area, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which the contract was concluded.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction.

Waiver of Withdrawal Right for Digital Services

By purchasing a SupaSkills subscription and expressly consenting to the immediate commencement of the service during the checkout process, you acknowledge that you lose your right of withdrawal once the service has begun. This is in accordance with Article 16(m) of the Consumer Rights Directive (2011/83/EU) and § 18 Abs 1 Z 11 FAGG.

License

You receive a personal, non-exclusive, non-transferable license to use Skills for your own professional work.

Permitted:

• Using Skills in your own Claude instance
• Copying individual system prompts for personal use
• Modifying Skills for your own purposes

Not permitted without Platform License:

• Systematically distributing prompts to third parties
• Embedding Skills in your own products for end users
• Building API wrappers that serve Skills to third parties
• Reselling or sublicensing Skills

Intellectual Property

Ownership

System prompts (“Skills”), scoring algorithms, quality frameworks (SupaScore), masterfiles, source compilations, and all associated metadata are the exclusive intellectual property of Kill The Dragon GmbH, protected under Austrian copyright law (Urheberrechtsgesetz, UrhG) and applicable international treaties.

The curated collection of Skills, including their selection, categorisation, scoring, and arrangement, is additionally protected as a database under EU Directive 96/9/EC (Database Directive). Systematic extraction or re-utilisation of a substantial part of the database is prohibited.

Confidentiality of System Prompts

System prompts delivered to you via the API, MCP protocol, or web interface are confidential. You may not publish, share publicly, upload to public repositories or forums, or otherwise disclose the full text of any system prompt to third parties. This includes posting prompts on GitHub, GitLab, social media, prompt-sharing platforms, or competing services.

AI Model Training Restriction

You may not use Skills, system prompts, or any content derived from the Platform to train, fine-tune, distill, or otherwise improve any machine learning model, large language model, or AI system, whether commercial or open-source. This includes using Skills as training data, evaluation benchmarks, or input for synthetic data generation.

Your Outputs

Everything you create with the help of a Skill, including code, text, analyses, designs, and documents, belongs to you. We claim no rights to your outputs.

Technical Protection

Skills may contain digital fingerprints or identifiers that enable us to detect unauthorised redistribution. Circumventing, removing, or altering any such technical protection measure is prohibited and may constitute a violation of applicable laws including the EU Copyright Directive (2019/790).

Enforcement

Unauthorised reproduction, redistribution, or publication of Skills (including posting system prompts on public repositories, forums, or competing platforms) constitutes copyright infringement. We actively monitor for unauthorised use and will pursue enforcement including:

• DMCA takedown requests for hosting platforms (GitHub, GitLab, etc.)
• Cease and desist notices under Austrian and EU copyright law
• Claims under the EU Database Directive for unauthorised extraction
• Legal action for commercial misuse

If you discover unauthorised use of SupaSkills content, please report it to legal@supaskills.ai.

Acceptable Use

Prohibited:

• Circumventing rate limits or slot restrictions
• Automated scraping of the skill catalog
• Reverse engineering scoring algorithms
• Using Skills for illegal purposes
• Creating multiple free accounts to circumvent limits

Liability

Our liability is limited to intent and gross negligence. Total liability is capped at fees paid in the preceding 12 months. For consumers under Austrian KSchG (Konsumentenschutzgesetz), statutory rules apply.

Skills are structured instructions for AI systems. We do not guarantee the accuracy, completeness, timeliness, or fitness of AI-generated responses for any particular purpose.

Sensitive Domain Skills

Skills in the following domains carry heightened risk and require independent professional verification:

• Health, Mental Health, Nutrition: Not medical advice, diagnosis, or treatment. AI may under-triage emergencies, hallucinate medical information, or provide dangerous dietary recommendations. Always consult a licensed healthcare professional. In emergencies, call your local emergency number immediately.
• Finance: Not financial advice, investment recommendation, or tax consultation. AI may hallucinate contribution limits, tax rules, or financial products. Consult a licensed financial advisor before making financial decisions.
• Legal: Not legal advice. Does not create an attorney-client relationship. AI-generated legal citations have documented fabrication rates of 43-88%. Consult a licensed attorney for any legal matter.
• Parenting, Relationships: Not a substitute for pediatricians, child psychologists, family therapists, or couples counselors. AI cannot assess individual children, family dynamics, or relationship situations from text descriptions.
• Code and Engineering: AI-generated code may contain bugs, security vulnerabilities, or architectural errors. We accept no liability for system failures, data loss, security breaches, or other damages caused by deploying AI-generated code without adequate testing and review.

Exclusion of Consequential Damages

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, personal injury, health complications, financial losses, legal consequences, or emotional distress arising from the use of Skills or AI-generated outputs, regardless of whether we have been advised of the possibility of such damages.

User Responsibility

You acknowledge and agree that:

• You are solely responsible for evaluating and verifying all AI-generated outputs
• You will not rely on AI-generated outputs as a substitute for professional advice in any domain
• You will seek qualified professional help for decisions with health, financial, legal, or safety implications
• You will test and review all AI-generated code before deploying to production environments

Service Discontinuation

Kill The Dragon GmbH reserves the right to temporarily or permanently discontinue the SupaSkills Platform. In the event of permanent discontinuation, active subscribers will be notified at least 30 days in advance by email. Already paid subscription periods will be refunded on a pro-rata basis.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days in advance by email. Continued use of the Platform after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you may cancel your subscription before the changes take effect.

Governing Law

Austrian law applies, excluding CISG. Place of jurisdiction is Vienna, Austria. For EU consumers, mandatory consumer protection provisions of their country of residence apply additionally.
